LookyHeer is a campaign validation tool. All payments are processed directly between Backers and Creators via Stripe Standard Connect. LookyHeer does not handle, collect, or store any pledge funds, and is not responsible for campaign fulfillment, refunds, or financial disputes.

1. Acceptance of Terms

Welcome to LookyHeer ("Company", "we", "our", or "us"). By accessing or using our website, services, applications, and embeddable widgets (collectively, the "Platform"), you agree to comply with and be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you may not access or use the Platform.

2. Description of Service

LookyHeer provides crowdfunding and pre-order validation software engines for creators ("Creators") to test demand for products and validate projects. Supporters ("Backers") can pledge funds to a campaign.

LookyHeer acts solely as a **neutral venue** and software supplier. We provide the tools for campaigns to be run and widgets to be embedded on external host websites, but we are not party to any agreements between Creators and Backers.

3. Stripe Standard Connect & Financial Flow

To enforce secure payments and protect users, LookyHeer integrates with Stripe, Inc. ("Stripe") using **Stripe Connect Standard Accounts**.

  • Direct Relationships: All payment processing is conducted directly between the Backer and the Creator's independent Stripe account. LookyHeer never acts as a depositary, escrow agent, or financial intermediary.
  • Card Authorization (SetupIntents): When a Backer places a pre-order pledge, the Platform utilizes Stripe's SetupIntents API to securely save their card credentials. No immediate charge is made, and no hold is placed on the Backer's bank account.
  • Execution of Charges: If and when the Creator's campaign successfully reaches its target goal, the Creator triggers the off-session charging of saved payment cards. The funds are transferred directly from the Backer's card to the Creator's Stripe account, minus a Platform fee.
  • Platform Fees: LookyHeer charges a fee (typically 1.0%) for providing the software service, which is automatically deducted by Stripe at the time the charge is executed.

4. Disclaimer of Liability for Fulfillment and Refunds

Because LookyHeer does not hold, manage, or distribute campaign funds, the following terms apply to all transactions:

Absolute Shift of Liability
  • Creator Responsibility: The Creator is the sole Merchant of Record. The Creator holds absolute legal responsibility for fulfilling campaigns, delivering products, and issuing refunds to Backers.
  • No LookyHeer Refunds: LookyHeer cannot issue refunds, transfers, or reversals. Any refund request, dispute, or complaint must be addressed directly to the Creator.
  • Platform Indemnification: Backers agree that pledging to a campaign carries an inherent risk of non-delivery. You release LookyHeer from any claims, damages, or losses resulting from a Creator's failure to fulfill their campaign promises.

5. Rules for Creators

As a Creator hosting a campaign on LookyHeer, you represent, warrant, and agree that:

  1. You will provide accurate, honest, and complete descriptions of your product and campaign goals.
  2. You are solely responsible for setting up and verifying your Stripe Standard account, including completing all Know Your Customer (KYC) details and submitting tax forms (such as 1099-K reporting) directly with Stripe.
  3. You assume all financial responsibility for chargebacks, customer disputes, bank fees, and negative account balances associated with your transactions.
  4. You will fulfill pre-orders in good faith and communicate transparently with Backers regarding shipping timelines and delays.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOOKYHEER, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR PARTICIPATION IN ANY CAMPAIGN.

7. Modifications to Service and Terms

We reserve the right to modify, suspend, or terminate the Platform or these Terms at any time without prior notice. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
